Privately negotiated sales

Terms of sale

These terms apply to the use of this website and to sales arranged through it by Jasper Antiques, Gippsland, Victoria, Australia. They follow ordinary Australian dealer practice for antiques, rare books and works of art sold by private enquiry, not by auction and not through an online shop.

This website

Listings are an invitation to enquire. They are not an offer capable of acceptance by clicking a button. There is no shopping cart and no online checkout. A message sent through the site does not reserve a piece and does not form a contract.

All items are offered subject to prior sale. Photographs, measurements and notes may be updated or a listing withdrawn without notice.

Descriptions

Descriptions, dates, attributions, authorship and condition notes are an opinion based on examination. They are given in good faith. They are not a guarantee unless confirmed in writing as part of the sale.

Antiques, books and works on paper are second-hand. Age, wear, restoration and earlier repairs are to be expected. Faults that can be seen in the photographs, or that are stated in the listing or in subsequent correspondence, form part of the description. Buyers should read the listing, look at photographs of marks and faults, and may inspect by appointment in Gippsland before paying.

How a sale is made

A contract is formed only when Jasper Antiques accepts the buyer’s written confirmation of the piece, the price and the terms, usually by email. Payment methods and timing are stated in that correspondence. Until then, either party may withdraw.

Prices are in Australian dollars and, unless stated otherwise, include GST where GST applies. Postage, packing, insurance and export costs are extra unless the written confirmation says they are included.

Payment, title and risk

Title passes on cleared payment. Goods are not released, collected or dispatched until funds have cleared. Risk passes on collection by the buyer, or on handover to a carrier nominated after the sale.

Viewing, collection and packing are by appointment. If dispatch is arranged, the method, cost and any insurance are agreed in writing first. Shipping damage must be reported promptly, with photographs of the parcel and the piece.

Returns

Change of mind is not a ground for return on a privately negotiated antique, book or work of art. Inspection before payment is offered for that reason.

If a piece is materially different from the written description agreed at sale, notify Jasper Antiques promptly, in writing, before returning it. The piece must come back in the same condition in which it was sent. A refund, repair or replacement, as the case requires, will then be discussed. Australian Consumer Law rights that cannot be excluded remain available to eligible buyers.

Website use

Content on this site, including photographs and catalogue notes, is for the purpose of identifying pieces offered for sale. It must not be copied for another commercial listing without consent. Do not misuse the enquiry form, attempt to interfere with the site, or submit false details.

Personal information sent through the site is handled as described on the Privacy page.

Governing law

These terms are governed by the law of Victoria, Australia. Enquiries may be sent through the Contact page or to jasperantiques@pm.me.
